HOW TO APPLY

The “Prosecution Documents” section of the Northcroft Collection is one of its most assorted sections. This is because a number of prosecution documents (the General Index of the Record of the Prosecution Case (IPS Document Number 0005) for example) are better suited and placed in other sections of the Northcroft collection. The “Prosecution Documents” section contains several interesting and valuable pieces of IMTFE documentation. Beyond the expected copies of the Prosecution’s Opening Statement and the Indictment, several other important Prosecution works are included. There are the replies to the Defence’s motions that are repeats of the Transcripts. Prosecution Evidence against Individual Accused is made up of 4 volumes (983 Pages). These volumes summarise the evidence against each defendant, including the counts of the Indictment charged against. They also include a description of the personal career of each of the Accused, including honours and decorations awarded to the defendant in question, and a chronological summary of “guilty” activities of the each defendant. This is done in alphabetical order. Please note that for no clear reason, Volume III (Oshima – Shiratori) does not include the summaries for the following defendants: Shigemitsu Mamoru, Shimada Shigetarō, or Suzuki Teiichi.

Unique to the Northcroft collection are the following documents: The Japanese Constitution and Government written and compiled by Brigadier H. G. Nolan, Canadian Associate Prosecutor, and Mr. Solis Horwitz, United States Attorney. This includes Nolan’s treatment, “An Examination of the [Japanese] Constitution and its Bodies of Government” and Horwitz’, “Gaps, Gray Areas, and Extra-Constitutional Bodies”. This work also includes notes by Lord Patrick, Member from Great Britain for the IMTFE. P. Lopez’, Associate Prosecutor for the Philippines, The Trial Scenario of Class C Offences in General and Class B and C Offences in the Philippines involves documents and evidence concerning Phases XIII and XIX of the Prosecution case. More specifically, Trial Scenario of Class C Offences includes: “The Opening Statement of the Associate Prosecutor of the Philippines on Class C Offences in General and Class B and C Offences in the Philippines” and exhibits and evidence supporting these accusations. These are mostly accounts of Japanese atrocities committed in the Philippines. Finally – and most unique to the Northcroft collection – is Brigadier R. H. Quilliam’s [Associate Prosecutor for New Zealand] Report on Proceedings of the IMTFE [To Prime Minister of New Zealand] (4 April 1948). This includes Brigadier Quilliam's thoughts on the IMTFE. Most notable is his harsh critique of Chief Prosecutor Joseph B. Keenan's ability and the negative impact that he had on the trial. This document is divided into the following sections: "Scope of Report"; "Causes of Proceedings being Protracted"; "Constitution of the Tribunal"; "Summary of Charter Provisions (as Amended)"; "Comments: a) Numerical Strength of Tribunal, b) Mixed Nationalities"; "Recommendations"; "The Prosecution"; "The Indictment"; "Aggressive War"; "Expediency of Holding Further Trials"; and "Was the Trial Justified".
